General Terms and Conditions of Sale

1. Seller

The N.11drink-branded products offered on the website https://n11drink.com (the “Site”) are sold by:

(the “Seller”).

2. Scope

These General Terms and Conditions of Sale (the “Terms”) govern the distance sale of the products offered on the Site to natural persons acting for purposes outside any business, commercial, craft or professional activity they may carry on (“Consumers” or the “Customer”), in accordance with Italian Legislative Decree No. 206 of 6 September 2005 (“Consumer Code”) and Italian Legislative Decree No. 70 of 9 April 2003 on electronic commerce. Bars, distributors and other trade customers may request dedicated terms by writing to n.11drink@gmail.com.

The Terms published on the Site at the time the order is placed apply. The Customer may consult, print and save them at any time; they are also referred to in the order confirmation email.

The Terms are available in Italian, English and German and the contract may be concluded in any of these languages. In the event of any conflict between the language versions the Italian version prevails, provided that any doubtful clause is interpreted in the manner most favourable to the Consumer (Article 35 of the Consumer Code).

3. Sales to adults only

The products are alcoholic beverages. Sales are reserved to persons who are at least 18 years old or, if higher, of the minimum age required to purchase alcoholic beverages in the country of delivery. In Italy the sale of alcoholic beverages to persons under 18 is prohibited (Article 14-ter of Italian Law No. 125 of 30 March 2001, introduced by Decree-Law No. 158 of 13 September 2012, converted with amendments into Law No. 189 of 8 November 2012).

To access the Site visitors must confirm that they are of legal age and, to complete an order, the Customer must declare in the cart that they are at least 18 years old or of the legal age required in their country. The Customer is responsible for the truthfulness of this declaration.

The Seller reserves the right not to accept, or to cancel, with a full refund of any amounts paid, orders where there are reasonable doubts about the age of the Customer or of the recipient, and to ask the courier to check an identity document on delivery. The products cannot be delivered to minors; see also the Shipping Policy.

4. Products and product information

The main characteristics of the products (name, spirit drink category, alcoholic strength by volume, nominal quantity, price and the other mandatory information required by Regulation (EU) No 1169/2011) are shown on each product page before the contract is concluded and are in any case stated on the label. In the event of any discrepancy, the label of the product delivered prevails.

Images are for illustrative purposes only: the colour of the liquid, the label, the packaging and accessories may differ slightly from the photographs, also owing to the artisanal nature of production and to screen settings, without affecting the main characteristics of the product.

The products are made artisanally in Lavagno (Verona) and marketed under the N.11drink brand.

5. Prices

Prices are expressed in euros. For deliveries in Italy, prices include VAT and excise duties. For deliveries to other countries, taxes, excise duties or customs duties of the destination country may apply, as set out in the Shipping Policy.

Shipping costs and any other charges payable by the Customer are shown separately at checkout before the order is placed. The total price shown in the order summary is the amount the Customer must pay. The Customer is not required to pay any charges of which they were not informed before the contract was concluded.

In the event of an obvious clerical error in the price (e.g. a manifestly derisory price resulting from a typing error), the Seller will promptly inform the Customer, who may confirm the order at the correct price or cancel it with a full refund of any amounts paid.

6. Orders and conclusion of the contract

To make a purchase the Customer must:

  • select the products and add them to the cart;
  • declare in the cart that they are of legal age to purchase alcoholic beverages;
  • enter the required details at checkout (email, delivery and billing address) and choose the shipping and payment method;
  • check the order summary, showing the total price including taxes and shipping costs, and correct any input errors using the editing functions available in the cart and at checkout;
  • place the order by clicking the final payment button, which entails an obligation to pay.

Placing the order constitutes a contractual offer. The contract is concluded when the Customer receives the order confirmation email, which summarises the products purchased, the price, the shipping costs and the delivery details and refers to these Terms and to the information on the right of withdrawal (confirmation on a durable medium pursuant to Article 51 of the Consumer Code).

The order is stored in the systems of the Seller and of the Shopify platform; Customers with an account can view it in their personal area and may in any case request a copy by writing to n.11drink@gmail.com. Any codes of conduct to which the Seller subscribes will be indicated in this section.

The Seller may refuse or cancel an order, refunding in full any amount paid, in the event of doubts about the legal age of the Customer or of the recipient, failed payment, well-founded suspicion of fraud, a destination that is not served or product unavailability.

7. Product availability

Products are offered while stocks last. If an ordered product is unavailable, the Seller will inform the Customer without delay and will refund without undue delay any amounts already paid for that product, unless the Customer accepts an alternative solution.

8. Payment

Payment is made when the order is placed through the payment providers shown at checkout (e.g. Shopify Payments, PayPal). Transactions are handled directly by the payment providers using security protocols; the Seller has no access to full payment card details. The Seller does not charge any additional fee for the use of a specific payment method.

9. Shipping and delivery

Areas served, costs, delivery times, couriers and delivery conditions are set out in the Shipping Policy, which forms an integral part of these Terms. Unless otherwise agreed, the Seller delivers the products within 30 days of the conclusion of the contract (Article 61 of the Consumer Code).

Products are delivered to adults only. The risk of loss of or damage to the products passes to the Customer when the Customer, or a third party indicated by the Customer other than the carrier, acquires physical possession of them (Article 63 of the Consumer Code).

10. Right of withdrawal

The Consumer has the right to withdraw from the contract, without giving any reason, within 14 days of the day on which the Consumer, or a third party indicated by the Consumer other than the carrier, acquires physical possession of the products (Articles 52-59 of the Consumer Code). The right of withdrawal does not apply to bottles whose tamper-evident seal has been removed or opened after delivery, as these are sealed goods which are not suitable for return due to health protection or hygiene reasons (Article 59(1)(e) of the Consumer Code). 11. Legal guarantee of conformity

The Seller is liable to the Consumer for any lack of conformity of the products which exists at the time of delivery and becomes apparent within two years of delivery, in accordance with Articles 128 et seq. of the Consumer Code. Unless proven otherwise, any lack of conformity which becomes apparent within one year of delivery is presumed to have existed at the time of delivery.

The Consumer loses these rights if the lack of conformity is not reported within two months of the date on which it was discovered; the right of action is time-barred 26 months after delivery. In the event of a lack of conformity the Consumer is entitled to have the goods brought into conformity by repair or replacement or, where provided by law, to a proportionate price reduction or to termination of the contract, free of charge.

To report a defective or damaged product or one that differs from what was ordered (e.g. a broken or leaking bottle), write to n.11drink@gmail.com, attaching photographs of the product and the packaging if possible. The costs of returning non-conforming products are borne by the Seller.

12. Liability

The Seller is not liable for damage resulting from improper or excessive use of the products, failure to comply with the warnings on the label, improper storage after delivery or false declarations of age. The Seller is not liable for delays or failures caused by force majeure or by other events beyond its reasonable control.

Nothing in these Terms limits or excludes the Seller's liability for wilful misconduct or gross negligence (Article 1229 of the Italian Civil Code), liability for defective products (Articles 114 et seq. of the Consumer Code) or the rights granted to the Consumer by mandatory provisions of law.

13. Responsible drinking

The Customer undertakes to consume the products responsibly and not to supply them to persons under 18. See the Responsible Drinking page. Please drink responsibly.

14. Personal data protection

The Customer's personal data is processed in accordance with Regulation (EU) 2016/679 and Italian Legislative Decree No. 196/2003, as described in the Privacy Policy and the Cookie Policy.

15. Complaints

Complaints may be sent to n.11drink@gmail.com, to the certified email address ristoranteallafassa@pec.it or by post to ALLA FASSA S.N.C. DI FELLER DONATELLA & C., Via B.G. Nascimbeni 11, 37010 Brenzone sul Garda (VR), Italy. The Seller will reply as soon as possible.

16. Governing law and jurisdiction

The contract is governed by Italian law. If the Consumer is habitually resident in another country, the choice of Italian law does not deprive the Consumer of the protection afforded by the mandatory provisions of the law of that country (Article 6 of Regulation (EC) No 593/2008, “Rome I”).

For disputes with Consumers resident in Italy, the court of the place where the Consumer is resident or domiciled has mandatory jurisdiction (Article 66-bis of the Consumer Code). For Consumers resident in another EU Member State, Regulation (EU) No 1215/2012 applies: the Consumer may bring proceedings before the courts of the Member State in which they are domiciled or of the Member State of the Seller, and may be sued only in the courts of the Member State in which they are domiciled. For cross-border disputes with a value not exceeding EUR 5,000 the Consumer may use the European Small Claims Procedure (Regulation (EC) No 861/2007).

17. Alternative dispute resolution (ADR)

The Consumer may use the out-of-court dispute resolution procedures provided for in Articles 141 et seq. of the Consumer Code, before ADR bodies entered in the relevant official lists, as well as mediation under Italian Legislative Decree No. 28 of 4 March 2010. If a complaint is not resolved, the Seller will inform the Consumer of the competent ADR body and whether it intends to take part in the procedure. Should the Seller subscribe to a specific ADR body, its details will be indicated in this section. For cross-border disputes the Consumer may also contact the European Consumer Centres Network (ECC-Net).

The European Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 following the repeal of Regulation (EU) No 524/2013 and is no longer available. The Consumer's right to bring proceedings before the competent court remains unaffected in all cases.

18. Final provisions

If any clause is invalid or ineffective, the remaining clauses remain valid. The Seller may amend these Terms at any time; amendments apply to orders placed after their publication on the Site.
